This is the main route for skilled migrants with a valid job offer from a licensed Sponsor to live and work in the UK.
Employers must either pay the migrant a minimum salary of either £38,700 or the going rate for the job. For ‘New Entrants’ (such as those who are 26 years old or a recent graduate) employers must pay at least 70% of the going rate for the job and the salary must be a minimum of £30,960 per year.
Due to the recent changes in Rules for Skilled Worker visas a SOC List Appendix 2020 has been introduced to reflect these changes; based on median Annual Survey of Hours and Earnings (ASHE) data. This Appendix replaces the SOC List Appendix in place before rules changes on 4th April 2024. There are seven tables a migrant may fall into tables: 1, 2, 2a, 2b, 3, 4, and 5; depending on their employment type, industry sector, previous grant of leave and job.
The Immigration Salary List, now replaces the Shortage Occupation List. The health and care visa now has further changes from 4th April 2024 in respect of new applicants applying as Care Workers and Senior Care Workers, under occupation codes 6135 and 6136 (previously known as 6145 and 6146) and they are no longer allowed to bring their dependents.
There is no maximum period in which you can reside in the UK as a skilled worker, although the maximum period you can be granted at any one time is 5 years (and 14 days or the time given on your certificate of sponsorship plus 1 month, whichever is shorter).
After 5 years, subject to meeting the requirements, an application can be made for Indefinite Leave to Remain.
