The Court of Protection is responsible for assisting people that never had or no longer have the mental capacity to make decisions. The Court ensures that vulnerable persons cannot be exploited, and that those responsible for their welfare are assisting appropriately.

 

The Court of Protection can make decisions on the behalf of the incapacitated person in relation to their health and welfare, and their property and financial affairs. Legal Aid funding is available in some cases.

 

Health and welfare cases consider decisions made in relation to the health or best interests of the incapacitated person. For example, there may be disputes over social care, an individual’s place of residence, contact with other persons or disputes regarding life-sustaining treatment or other medical treatment.

 

Additionally, health and welfare cases often relate to someone’s contact with others, deprivation of liberty, their capacity to marry, their capacity to consent to sexual contact, or their capacity to make decisions about contraception and pregnancy.
