Hello, and I’m Aina Khan, and I’m the head of the Islamic and Asian department at Duncan Lewis Solicitors. I have been very concerned to note that in the last five years there have been an increase in number of calls to me, often several times a day from women who don’t know if they are legally married because they’ve had an Islamic marriage registered in the UK and they think they are protected but it is not a legal marriage under English Law, is just registered by the Imam or in a Mosque, it looks like an official marriage but it is not recognised. The consequences can be devastating as you are classed as a girlfriend or a cohabitee and in the UK we have no cohabitation rights. It is only by being legally married that you are able to get financial rights and to have maintenance to survive if the relationship breaks down.

 

I feel so strongly about this that I’ve started my own campaign called, ‘Register our marriage’, which asks for two things:

 

  • It asks the government to change the law to cover all faiths so that they have to register their marriages under English law and there are no excuses for not telling women their rights
  • The process of education so that all the women here and abroad who are in marriages which they feel insecure because they are not having a legal marriage would have an option before they find themselves in that situation to get expert help.
