Human Trafficking is when an individual or another person exploits the victim either inside our outside the UK. This offence is committed when the offender is involved in any of the following:

1. Arranging for the victim to travel into the UK from another country to enable the offender to or another person to exploit the victim; OR
2. Where the offender did not directly make the arrangements he will still be guilty of the offence if he has done anything to facilitate the victim’s journey into the UK with the intention to exploit or allow another person to exploit the victim; OR
3. Where the victim’s journey was arranged or facilitated by the offender from one part of the UK with the intention of the offender or another person to exploit the victim

In several cases the victim is exploited by being forced to work for the benefit of the offender or another person. An important nature of human trafficking is that the person being charged with the offence of human trafficking could also be a victim of the same offence.

It is therefore important to note that there are certain defences to immigrating offences for victims of human trafficking.
