Family Mediation is when a professional trained mediator speaks to separated parties about arrangements for their children or about the family’s property and finances. The aim is for the mediator to help the parties to reach an agreement and avoid the need to go to court.

Family Mediation remains available under legal aid – which means that if you are financially eligible you will not have to pay for it. The first step in the mediation process is for each party to attend a Mediation Information and Assessment Meeting. If at least one party is eligible for legal aid then neither party is required to pay to attend the Mediation Information and Assessment Meeting.

It is now a requirement in almost all cases that at the very least a Mediation Information and Assessment Meeting is attended before an application can be made to the court in a family matter.

If you attend at least one session the Mediator can also sign a form which would permit you, provided you are financially eligible, to receive legal aid about the matters being discussed, any agreement reached, and the next steps you may wish to take. This form of legal aid is called ‘Help with Mediation’.
