Following a number of changes to legal aid, restricting its availability and family proceedings victims of domestic abuse have found themselves in a vulnerable position of attending court without representation. Where evidence of domestic abuse is available and complies with the statutory requirements private children and family law proceedings may be bought back into the scope of legal aid.

 

Recent case law has extended the time limit that evidence can be used for, from 2 years to 5 years which has assisted somewhat, the position is still far from ideal. Where a client is seeking an injunction from the courts to protect them from further harm the evidential requirements do not apply as these applications remain in scope, subject to mean and merits assessment.
