The Court of Protection can be used to help resolve disputes that concern the health and welfare or property and finances for people who lack the mental capacity to make these decisions. As part of this process the court makes decisions about what is in the person’s best interests. The court can also decide whether or not a person has the mental capacity to make any specific decision.
The team at Duncan Lewis regularly represents a person in proceedings and we also liaise with the family of the incapacitated person and professional advocates’ such as Relevant Persons Representative (RPR's) and Independent Mental Capacity Advocates (IMCAs). RPR’s and IMCAs have additional safeguarding roles and sometimes these persons act as litigation friends of the proceedings. The role of a professional advocate is to provide a voice for the person of the proceedings and to inform the court of their wishes and feelings. RPR’s also have legal obligation to assist the person to challenge a Deprivation of Liberty in the Court of Protection, in certain circumstances.
