Winchester Crown Court has sentenced two men convicted of supplying defective medicines.
The court heard that 51-year-old Gary Rafferty and 54-year-old Graham Butler – director of VMS Solutions Limited – were involved in a scam to sell defective Buttercup Syrup cough medicine to retailers.
In 2012, Rafferty supplied Butler with quantities of the children’s cough remedy Buttercup Syrup, knowing that the batch was defective and due to be destroyed.
Butler – acting as director of VMS Solutions Limited – then sold the defective Buttercup Syrup on to retailers.
The Medicines Regulatory and Healthcare products Agency (MHRA) subsequently seized the defective cough mixture from the retailers.
The court heard that Rafferty had also taken possession of large quantities of defective controlled drugs – and had failed to arrange for their destruction.
MHRA investigators seized more than 4,000 litres – the equivalent of 400,000 doses – of the drugs liquid Tamazepam and Diazepam, as well as more than 23 litres of diazepam syrup.
Rafferty pleaded guilty to one count of possessing a controlled drug, one count of unlawful distribution of medicinal products and one count of managing a company in contravention of a disqualification. He was sentenced to five months in prison, suspended for one year.
Butler pleaded guilty and received a conditional discharge. His company VMS Solutions Limited was ordered to pay a fine of £10,000.
