A Merthyr Tydfil recycling firm has been handed a fine for insufficiently controlling a Legionella risk during a Legionnaire's disease outbreak in September 2010. While Merthyr Industrial Services (Biomass) Limited was not held responsible for the outbreak, the Health and Safety Executive (HSE) agreed that the company had put its workers and the general public at risk. The company received a £600 fine from Merthyr magistrates and was ordered to pay costs totalling £8,577.

HSE inspectors had visited the company’s premises in September 2010. They found that the firm had been sporadically operating an on-site cooling tower in the absence of suitable measures to control the risk of Legionella bacteria proliferation over a five-week period. The company was handed a prohibition notice to prevent the use of the cooling tower until sufficient controls were in place. HSE inspectors found no single source to be responsible for the Legionnaire’s disease outbreak; investigations suggested that several possible sources could have accounted for the outbreak.

Stuart Charles, a HSE inspector, claimed that while the company was not considered one of the sources responsible for the Legionnaires' disease outbreak, it was imperative that all firms operating cooling towers at their premises fully understood the risks of the Legionella bacteria and the requirement for sufficient measures to control the risk.
