A Manchester father who choked on a mould that was mistakenly left inside of a crisp packet has been awarded £3, 500 in personal injury compensation. Peter Collins instigated legal action against the popular crisp manufacturer, Walkers. A settlement was reached almost four years after the incident took place.

In 2008, Mr. Collins’ son, Joshua, cleared his airway after he begun to choke on the rubber mould. Mr. Collins believes that his son’s actions saved his life. The rubber mould, which is the exact same colour, size and shape as a crisp, was found inside of a packet of crisps derived from a multi-pack purchased at Mr. Collins’ local supermarket. Mr. Collins was later informed by his doctor that chemicals from the mould had oozed into his stomach. Mr. Collins underwent a series of medical tests and was prescribed a three-month course of drugs designed to combat his feelings of nausea and lack of appetite. After the incident, Mr. Collins claimed that he lost weight, as he could not face eating his food. He added that it took him around three months to feel like his usual self.

Mr. Collins enlisted the help of a personal injury solicitor to take legal action. Walkers acknowledged liability. Mr. Collins’ solicitors claimed that Walkers were negligent and expressed her delight at the compensation win. Walkers refused to comment on Mr. Collins’ case.
