An 11-year-old boy has received a five-figure compensation sum after suffering a personal injury eight years ago while on holiday in Tunisia following an incident involving a dart.
The boy, who has been named as Toby Corps from Ashford Kent, was just five when he was hit in the eye by another child with the errant dart which was thrown during a supervised game organised by the three-star Dar Khayam Hotel in Hammamet.
Toby's barrister Clara Johnston said of the incident in court documents: “The children took it in turns to throw darts at the board. One participant whose name is unknown took his turn. When he had finished he went to retrieve the darts. Toby was then called up by a member of the animation team to take his turn. As he waited, the other child threw a dart towards him, which hit him in the left eye.”
Toby suffered extensive injuries following the accident and immediately required eye surgery where he had a cataract removed. He also suffered a detached retina that took several months to heal.
The boy has now been awarded £50,000 in damages after the courts agreed that the young children should not have been permitted to use the sharp instruments due to the likelihood of such injuries occurring. The damages will be paid by accommodation provider, youtravel.com and Future Travel, the tour operator.
