Ashya’s case under “immediate review”, says CPS (2 September 2014)

Duncan Lewis, Legal News Solicitors, Ashya’s case under “immediate review”, says CPS

The parents of five-year-old Ashya King are currently being held in custody in Madrid, after saying they do not wanted to be extradited to the UK.

Ashya was found at a hostel in Malaga Spain by Spanish police, after his father removed him from Southampton General Hospital on Friday (29/08/14) against medical advice and without advising staff there.

The family then headed for Spain with Ashya and are believed to have been making their way to the Czech Republic, where there is a clinic offering Proton Beam therapy to treat Ashya’s brain tumour.

Ashya’s disappearance from the hospital in Southampton sparked a police search for him – and a European arrest warrant was issued for his parents.

The family have criticised the police for their actions and for “criminalising” Mr and Mrs King for removing their son from hospital to seek further treatment for Ashya.

Hampshire Police say that once medics had raised concerns that Ashya’s health might be at risk, they had no option but to search for him.

Ashya is now being treated at a children’s hospital in Malaga on Spain’s Costa del Sol – he is alone and does not understand Spanish, but his elder brother has now been allowed to visit him while his parents are in custody in Madrid.

The Crown Prosecution Service (CPS) in the UK says the case is now under immediate review.
