Marilyn's High Net Worth Divorce Profile / Experience

Marilyn is a Supervisor and Solicitor in the Family and Child Care Department at Duncan Lewis and represent clients in all aspects of Family Law matters.

She aims to provide comprehensive practical legal advice and assistance to those facing breakdown in their relationship. Whether separating couple is married, engaged, in a civil partnership or living together as cohabitees. Her speciality is resolving financial disputes concerning the division of property and assets. This includes issues surrounding the future care of the child (ren) and domestic abuse. She also has a strong expertise in drafting pre and post-nuptial agreements and separation agreements. Her approach to the resolution of disputes is constructive, respectful and non-confrontational and her aim is to help couples separating “without lawyering up”. The aim is to resolve family disputes in a less stressful environment amicably and without having to attend court thereby allowing the separating couple more control of the process and the outcome. Marilyn recognises the emotional strain caused by the breakdown of a relationship can be overwhelming and is committed to provide honest advice, manage expectations and provides practical solutions to empower clients to make informed decisions about their future. She deals with separation matters, from low to high net worth.
She finds her work incredibly rewarding, and never takes for granted the fact that she is dealing with real people in real life situations, which require her complete dedication. She always seek to ensure the best outcome that she can, whilst considering the commercial cost to the client in doing so.

She undertakes the majority of my own advocacy where she can, and often appears before District, Circuit, High Court Judges and Magistrates.

In addition, she has extensive experience in both public and private law children matters and supervise a team of solicitors, trainee solicitors and paralegals all dedicated to representing the most vulnerable in society. She has experience in public law cases involving multiple complex elements including non-accidental injuries, child sexual exploitation, secure accommodation orders, physical and sexual abuse, and mental health issues. She is a member of the Law Society's Children Panel, which means she has demonstrated and achieved a high level of competence and specialist knowledge, as defined by the Law Society in all areas of children law and the representation of children. She also have considerable experience representing parents, extended family members and interveners, and undertakes her own advocacy.

Marilyn additionally undertake all forms of private law children work, including live with and spend time with chid arrangements, and disputes over issues such as schooling and medical treatment and relocation out of the jurisdiction. Marilyn deals sensitively with the often-difficult circumstances of such applications as well as offering realistic and practical advice. She has experience of representing those who have numerous contested applications in private family law, including non-molestation orders, occupation orders, child arrangements orders, and a transfer of tenancy. She has also successfully made applications for a S91 (14) Children Act 1989 – a barring act – a rare and draconian order prohibiting a parent from making repeated and unreasonable applications for contact without seeking the court’s permission.

She has been instrumental in running a variety of pro bono clinics with various domestic violence organisations/charities, churches and foodbanks for many years and has a particular interest in securing protection through emergency injunctions for victims of abuse and ensuring that those who have no or limited access to justice are afforded such access and at times undertaking pro bono advocacy. In addition, she has also undertaken pro bono work as a volunteer at the Citizens Advice Bureau specialist Family Advice Centre, based in Croydon
