Habeas Corpus

Habeas Corpus

You might be able to challenge your detention under habeas corpus.

A challenge to detention under the ancient writ of habeas corpus is made when you and your solicitor believe that the Home Office does not have the jurisdiction to detain you. We may use this remedy for tactical reasons, but it is rare and we usually challenge detention through judicial review. We can advise you on the difference between habeas corpus and judicial review.
