In order to assist the Court with its decision making process, within Private Children Law Proceedings, the Court may order either Cafcass or the Local Authority to undertake a Section 7 Report.
The report will provide the court with further information about the welfare of the subject child, what is best for the child and will assist to identify where there are certain risk factors or concerns raised in relation to a child, parent or other relative.
They will prepare an independent report, which deals with all aspects of the welfare checklist under Section 1 of the Children Act 1989 and will provide recommendations as to what should happen in respect of the application before the court.
Upon reviewing the recommendations and taking into account the respective positions of each of the parties to the proceedings, the court will make a final decision in relation to the application.
