A teenager seriously injured in the Alton Towers Smiler ride crash is expected to make a claim for “substantial” damages, her legal team say.

Vicky Balch, 19, has had her condition downgraded from “critical” – which gives patients a 50-50 chance of survival – to “serious”.

The other three patients who are recovering from serous injuries after the crash on Thursday (04/06/15) are 27-year-old hotel assistant manager Daniel Thorpe from Buxton in Derbyshire – as well as 18-year-old textile design student Joe Pugh from Barnsley in South Yorkshire, and his girlfriend, 17-year-old Leah Washington.

Merlin Entertainments operates Alton Towers in Staffordshire and chief executive Nick Varney has said that safety measures “were not adequate” at Alton Towers.

He has defended the decision to close other rides at the theme park – 16 passengers were injured after the carriage they were riding in hit a stationery wagon on the track.

The four most seriously injured passengers were seated at the front of the carriage and sustained leg and other injuries.

Ms Balch’s lawyer said that it was anticipated there will be “a substantial claim for damages” to support her recovery.

He added that the main focus for the family was, however, their daughter’s wellbeing – and ensuring that the investigation into the accident was “carried out swiftly and vigorously”.

The police and the Health and Safety Executive are conducting an investigation into what caused the crash, which could result in criminal prosecutions.

Ms Balch suffered potentially life-changing injuries in the crash – and it is also reported that one of those seriously injured at Alton Towers has lost a leg.
