The Health and Safety Executive (HSE) has successfully prosecuted a facilities management company, after a worker sustained injuries relating to hand arm vibration.
Between 2007 and 2012, an employee of UPP (Broadgate Park) Limited operated mowers, strimmers and a leaf blower as part of his work for the company.
He was regularly exposed to levels of vibration above the Exposure Limit Value and Exposure Action Value.
The employee reported symptoms of hand arm vibration to his line manager, but no action was taken.
At Nottingham Magistrates‘ Court, UPP (Broadgate Park) Limited of Gracechurch Street in London was prosecuted by the Health and Safety Executive.
The company pleaded guilty to breaching Section 2(1) of the Health and Safety at Work etc Act 1974 and Regulation 5(1) of the Control of Vibration at Work Regulations 2005.
Section 2(1) of the Health and Safety at Work etc Act requires an employer
… to ensure, so far as is reasonably practicable, the health, safety and welfare of all its employees.
Section 5(1) of the Control of Vibration at Work Regulations 2005 states:
An employer who carries out work which is liable to expose any of his employees to risk from vibration shall make a suitable and sufficient assessment of the risk created by that work to the health and safety of those employees and the risk assessment shall identify the measures that need to be taken to meet the requirements of these Regulations.
UPP (Broadgate Park) Limited was fined a total of £14,000 and ordered to pay full court costs of £1,943.
