There are 2 types of interview under caution at the police station.  The 1st is the interview under caution without an arrest and 2nd is the interview under caution following an arrest.

 

In order to conduct an interview without an arrest the police officer dealing with the case will invite you to attend the police station on an agreed date and time.  You are expected to contact your solicitor to attend the police station with you and provide legal advice free of charge.  It is important to note that you are not under arrest and have the right to leave the police station at any time.

 

The 2nd type of interview follows an arrest. You are brought before a senior police officer who will explain your rights including the right to receive legal advice from your solicitor of choice or the duty solicitor.  If you do not have a solicitor, the call centre is responsible for calling out and allocating a duty solicitor to you for that interview.

 

The significance of both types of interviews under caution with or without arrest is that the record of the interview can be used in a court case about the alleged offence.

 

Before the interview the solicitor will obtain information about the allegation from the relevant police officer and then have a private meeting with you to discuss the allegation and listen to your account.  This should put the solicitor in a good position to advise you in relation to the interview.

 

The solicitor will also protect your rights whilst you are at the police station.  Following the interview the solicitor will remain in contact with the police to confirm the outcome of the interview.
