Aina Khan, Head of Duncan Lewis Solicitor’ Islamic law department was interviewed on BBC Newsnight on the 9th October 2015.
Aina said:
"I was asked 'How do Judges decide who is radical and harming their children? Should their children be taken away from them?' In the UK, we are facing an increasingly high number of cases of teenagers being taken into Care by Social Services, because parents are not protecting them from significant harm e.g. kids are accessing extremist material at home or even going to join ISIS. The presenter, Emily Maitlis, asked about the latest guidance from the President of the Family Division, James Munby, on Radicalisation and how a Judge decides 'What is too much?'. I talked about the burden of proof and high standard of evidence required - and that there is still no objective test for 'radicalisation'.
